Havre Medical Malpractice Lawyers: Hospital Errors, Delayed Transfers, Misdiagnosis and IHS Claims on the Hi-Line

Boland Aarab PLLP.

Rural health care makes medical malpractice cases on the Hi-Line different. Havre’s hospital is not a designated trauma facility. The nearest regional trauma center is in Great Falls, about 110 miles away. And care at Indian Health Service and tribal facilities is governed by federal law. Most Montana malpractice claims must go to the Montana Medical Legal Panel first and be filed within 2 years. Federal claims have their own 2-year presentment rule.

How does health care work on the Hi-Line?

Northern Montana Hospital, Havre. The hospital at 30 13th Street is part of Northern Montana Health Care. It provides emergency, surgical, obstetric, oncology, orthopedic, dialysis and behavioral health services, including robot-assisted surgery (NMHC). On the state’s November 2025 list, it is not designated as a trauma facility (DPHHS).

Transfers. The nearest higher-level trauma center is Benefis Healthcare in Great Falls, an ACS Level 2 / Regional Trauma Hospital. Montana’s only Level 1 centers are in Billings. That makes the decision to transfer, and how fast it happens, central to many Hi-Line cases. Common questions include whether a stroke, heart attack, sepsis, internal bleeding or spinal injury was recognized in time, whether the patient was stabilized properly, and whether transport was requested when it should have been.

Smaller Hi-Line hospitals. Logan Health Chester and Logan Health–Shelby are Trauma Receiving Facilities. Phillips County Medical Center in Malta and Big Sandy Medical Center are not designated. Small hospitals are not expected to do everything, but they are expected to recognize what they can’t do and to send the patient where the care is available.

Indian Health Service and tribal health care. The IHS Fort Belknap Service Unit runs a small critical access hospital at Fort Belknap Agency near Harlem. The Chippewa Cree Tribe runs the Rocky Boy Health Center near Box Elder. A claim over care at an IHS facility, or at a tribal program operating under a federal self-determination contract, is generally brought against the United States under the Federal Tort Claims Act, because those tribal programs are “deemed to be part of the Public Health Service” (25 U.S.C. § 5321(d)). That changes almost everything about the case:

  • A written administrative claim must be presented to the agency within 2 years (28 U.S.C. § 2401(b)).
  • The claim goes to federal court, not the Montana Medical Legal Panel.
  • A judge, not a jury, decides the case.

We handle these claims carefully and with respect for tribal sovereignty. Whether a specific provider or program is covered by the FTCA has to be confirmed in each case.

What happens after medical malpractice in Havre?

Get the records. Request the complete chart from every facility involved, including emergency department notes, nursing notes, imaging, transfer paperwork and transport run sheets. Records from a Havre-to-Great Falls transfer are held in at least two systems.

The panel. Before filing a lawsuit against a physician or a licensed health care facility, a Montana claim must be submitted to the Montana Medical Legal Panel (§§ 27-6-301, 27-6-701, MCA). Filing with the panel pauses the deadline (§ 27-6-702, MCA).

The court. After the panel, a claim arising from care in Havre is generally filed in the Twelfth Judicial District Court at the Hill County Courthouse, 315 4th Street (§ 3-5-101, MCA). If the negligent care happened at Benefis, the case may belong in Cascade County instead. FTCA claims are heard in the U.S. District Court. For Hill and Blaine Counties, that is the Great Falls Division (D. Mont. L.R. 1.2(c)(3)).

Montana law that applies

See our Montana medical malpractice lawyer page for the full rules. In brief:

  • Deadline: 2 years from the injury, or from when it was or should have been discovered, and never more than 5 years (§ 27-2-205, MCA).
  • Cap: Noneconomic damages are limited to $350,000 for claims first filed with the panel in 2026, rising to $400,000 on January 1, 2027 (§ 25-9-411, MCA). Medical bills and lost earnings are not capped.
  • Experts: Montana sets strict rules for who can testify on the standard of care (§ 26-2-601, MCA).

Why hire a Great Falls firm for a Havre case?

Great Falls is where many Hi-Line patients end up after a transfer, and it is where the federal court for FTCA claims from Hill and Blaine Counties sits. Our office is there. We handle cases statewide and travel to Havre for client meetings, depositions and court. We do not have a Havre office.

Frequently Asked Questions

Is Northern Montana Hospital a trauma center? Not according to the state. DPHHS’s November 2025 list shows Northern Montana Hospital in Havre as “Not Designated.” The nearest regional trauma hospital is Benefis in Great Falls.

My family member should have been transferred out of Havre sooner. Is that malpractice? It can be. The question is whether the providers met the standard of care in recognizing the condition, stabilizing the patient and arranging transfer. That is decided with qualified medical experts and the records from both facilities.

The care happened at the IHS hospital near Harlem or the Rocky Boy Health Center. What’s different? Those claims are usually brought against the United States under the Federal Tort Claims Act. You must first present a written claim to the agency within 2 years, and the case is decided by a federal judge.

Do I have to go through the Montana Medical Legal Panel? For most claims against Montana physicians and licensed facilities, yes. Filing with the panel pauses the deadline. FTCA claims against the United States do not go to the panel.

Is there a cap on what I can recover? Montana caps noneconomic damages in malpractice cases ($350,000 for claims first filed with the panel in 2026). Economic losses, such as medical costs and lost earnings, are not capped.
