Butte Boating Accident Lawyers: Georgetown Lake, Clark Canyon Reservoir, River Float and Jet Ski Accidents Near Butte

Boland Aarab PLLP.

If you were hurt in a boating, jet ski or float accident on the waters Butte residents use, such as Georgetown Lake, Clark Canyon Reservoir or the rivers of southwest Montana, you can usually recover from the operator who caused it, and Montana law also makes the boat’s owner liable for negligent operation by anyone the owner let use it. Most claims must be filed within three years, and a claim involving a federal reservoir can have a two-year notice deadline.

Where do Butte boating accidents happen?

Silver Bow County has no large lake of its own, so most Butte boaters trailer to waters in neighboring counties. That affects who investigates, which court hears the case and who may be responsible.

  • Georgetown Lake. About 2,800 acres at roughly 6,300 feet, Georgetown Lake straddles the Granite County and Deer Lodge County line west of Anaconda, off Montana Highway 1. It has several boat launches and a marina and draws powerboats, anglers, paddlers and, in winter, ice fishers and snowmobiles. At that elevation the water stays cold well into summer, and afternoon wind can build quickly on open water.
  • Clark Canyon Reservoir. A Bureau of Reclamation reservoir about 20 miles south of Dillon off I-15, with roughly 4,900 surface acres, concrete ramps and campgrounds (Reclamation). Because it is a federal facility, an accident involving federal property, employees or contractors can bring in the Federal Tort Claims Act.
  • Rivers. Butte families float and fish the Big Hole, Jefferson and upper Clark Fork. Rafts, drift boats and kayaks are “vessels” too, and collisions, capsizings and rental or outfitter negligence can support claims.

What happens after a boating accident near Butte?

Reporting. An operator involved in an accident must give assistance and exchange identification in writing. An accident involving death, disappearance, injury or more than $2,000 in property damage must be reported immediately to the county sheriff or a game warden (§ 23-2-527, MCA). Near Butte that usually means the Granite County Sheriff or Anaconda-Deer Lodge law enforcement for Georgetown Lake, the Beaverhead County Sheriff for Clark Canyon, or a Montana Fish, Wildlife & Parks warden. Ask for the report number.

Treatment. Georgetown Lake is closest to the Community Hospital of Anaconda, designated a Community Trauma Hospital, and Clark Canyon to Barrett Hospital & Healthcare in Dillon, also a Community Trauma Hospital. Serious injuries are often sent on to St. James Healthcare in Butte, an ACS Level III / State Area Trauma Hospital, or farther (DPHHS, Nov. 2025).

Courts. A lawsuit can generally be filed where the accident happened or where a defendant lives. For Georgetown Lake, that could be the Third Judicial District (Deer Lodge, Granite and Powell Counties); for Clark Canyon, the Fifth Judicial District (Beaverhead, Jefferson and Madison Counties); and when the operator or owner lives in Butte, the Second Judicial District in Silver Bow County (§ 3-5-101, MCA). Claims against the United States go to federal court, which sits for this region at the Mike Mansfield Federal Courthouse in Butte (mtd.uscourts.gov).

Evidence. Water erases evidence. Photograph the boats, the damage, the launch and your injuries; get the registration numbers of every vessel; save phone video and rental paperwork; and do not let the boat or jet ski be repaired or sold before it is inspected.

Does federal maritime law apply on these waters?

Probably not on most of them, but it depends on the water. Admiralty jurisdiction generally requires waters usable as highways of interstate commerce (28 U.S.C. § 1333). In Adams v. Montana Power Co., the Ninth Circuit found no admiralty jurisdiction over a drowning below Hauser Dam on the Missouri, because dams obstructed that stretch and its only commerce was recreation (528 F.2d 437 (9th Cir. 1975)). Dammed reservoirs and mountain lakes near Butte are likely to be governed by Montana law, but we confirm it at the start.

Montana law that applies

Briefly. Our Montana boating accident lawyer page covers boating law in more depth.

  • Negligent or impaired operation is prohibited, including wake-jumping too close to another boat and operating under the influence of alcohol or drugs (§ 23-2-523, MCA).
  • Owner liability: a vessel’s owner is liable for negligent operation by someone using it with consent, and consent is presumed for immediate family (§ 23-2-505, MCA).
  • Jet skis: everyone aboard must wear a Coast Guard-approved life jacket, and no-wake speed is required within 200 feet of docks, swimmers and anchored or nonmotorized boats (§ 23-2-531, MCA).
  • Rentals: a motorboat or jet ski over 10 horsepower may not be rented to anyone under 18 (§ 23-2-523(12)), and a signed release must meet strict statutory requirements (§ 27-1-753, MCA).
  • Deadlines: generally 3 years (§ 27-2-204, MCA); a claim against the United States must be presented within 2 years (28 U.S.C. § 2401(b)).

Frequently Asked Questions

Who do I report a Georgetown Lake boating accident to? To the county sheriff or a game warden, immediately, if anyone was hurt or property damage exceeds $2,000. Georgetown Lake lies in Granite and Deer Lodge Counties.

Is an accident at Clark Canyon Reservoir different? It can be. Clark Canyon is a Bureau of Reclamation reservoir, so a claim involving federal facilities or employees must be presented to the agency within two years.

My friend was driving his boat when I was hurt. Is the owner responsible? Generally yes, if the operator was using the boat with the owner’s consent and was negligent (§ 23-2-505, MCA).

Can I bring a claim after a raft or drift boat accident on the Big Hole or Jefferson? Possibly, against a careless operator, outfitter or rental company. Releases signed with outfitters and rental companies must meet statutory requirements.

Can my case be filed in Butte if the accident was at Georgetown Lake? Sometimes. A case can generally be filed where the accident happened or where a defendant lives, so a Butte-resident operator may be sued in Silver Bow County.
