Kalispell Spinal Cord Injury Lawyers: Paralysis and Back and Neck Injuries from Flathead Valley Crashes, Falls and Recreation

Boland Aarab PLLP.

A spinal cord injury in the Flathead Valley can mean a lifetime of care, and Montana law lets you recover for harm that is certain to happen in the future. Most claims must be filed within three years, in the Eleventh Judicial District Court in Kalispell or in federal court in Missoula. The size of the case depends on a careful, local life-care plan.

How do spinal cord injuries happen in the Flathead Valley?

Nationally, vehicle crashes (37.1%) and falls (32.5%) have caused most traumatic spinal cord injuries since 2015, according to the National Spinal Cord Injury Statistical Center (NSCISC, 2026). In northwest Montana, both show up in particular ways:

  • Rollovers and head-on crashes on two-lane highways. US-2 east of Columbia Falls, US-93 north toward Eureka and MT-35 along Flathead Lake are two-lane roads for long stretches. A pass gone wrong, a drowsy driver or a vehicle sliding on ice can mean a high-energy crash, often far from help.
  • Falls in construction and industry. Roofing and framing on the valley’s new homes, work at height in mills and on commercial projects, and falls from ladders and scaffolds.
  • Recreation involving someone else’s negligence:
  • a boat operator on Flathead Lake;
  • a snowmobile or ATV with a defect;
  • an outfitter or guide who ignored safety rules;
  • a property owner whose dock or stairs failed.
  • Horse and ranch work. The valley still has working ranches and stables, and equipment and livestock injuries can be catastrophic.

Montana law draws lines around some recreation. For example, skiers accept legal responsibility for injuries that result from the inherent dangers of skiing (§ 23-2-736, MCA). But negligence by an operator, another person, or the maker of defective equipment is not an inherent risk. The difference often decides whether there is a case.

What happens after a spinal cord injury in Kalispell?

Emergency and specialty care. Spinal injuries in the Flathead are usually taken to Logan Health Medical Center in Kalispell. It is a state-designated trauma hospital that lists neurosurgery, including pediatric neurosurgery, among its trauma specialty services. Some patients are flown in by Logan Health’s air-ambulance program, long known as A.L.E.R.T. After surgery and stabilization, many patients with a new spinal cord injury go to a specialized SCI rehabilitation program, which may be outside Montana. Their families travel with them, and those costs are part of the case.

Building the case.

  1. Preserve evidence. Vehicle data, the scene, the ladder or equipment, and witness accounts. The responding agency’s report comes from:
  2. the Montana Highway Patrol on the highways;
  3. the Kalispell Police Department in town;
  4. the Flathead County Sheriff’s Office elsewhere;
  5. federal OSHA for workplace falls.
  6. Life-care planning. An SCI life-care plan covers attendant care, equipment and replacement schedules, medications, therapy, and complications such as pressure injuries and infections. It also covers home and vehicle modifications. For a Flathead family, that has to include snow and ice access, the travel to specialists, and the availability of caregivers in a rural area.
  7. Economic loss. Lost earning capacity, household services and the value of care provided by family.
  8. Filing. A state-court case goes to the Eleventh Judicial District Court at the Flathead County Justice Center, 920 South Main Street, Kalispell. Cases against out-of-state manufacturers, carriers or companies are often removed to the federal Missoula Division, at the Russell Smith Courthouse.

NSCISC estimates lifetime costs of $6,419,617 for high tetraplegia injured at age 25, in 2025 dollars and not counting lost wages (NSCISC Facts and Figures at a Glance, 2026). Every client’s plan is individual, but the scale is why coverage and responsible parties must be identified early.
