Kalispell Medical Malpractice Lawyers: Hospital, Surgical and Diagnosis Errors in the Flathead Valley

Boland Aarab PLLP.

A Kalispell medical malpractice claim usually has to be submitted to the Montana Medical Legal Panel before a lawsuit can be filed in the Eleventh Judicial District Court. The deadline is generally two years from the injury or its discovery. Montana limits noneconomic damages. The hospital’s records and audit trails are the key evidence.

How does health care in the Flathead Valley shape a malpractice case?

One large regional system. Most hospital care in the valley runs through Logan Health. Logan Health Medical Center on Buffalo Hill, formerly Kalispell Regional Medical Center, is a 192-bed regional referral center. Logan Health says it serves a 20-county region covering nearly 50,000 square miles. The system also operates Logan Health – Whitefish and clinics across the region. In September 2023 Logan Health and Billings Clinic combined into one health system. When a malpractice claim involves the emergency department, the hospitalist, the surgeon and the follow-up clinic, those providers are often part of the same organization. Identifying who employed each provider, and which facility’s policies applied, is an early task.

Referral and transfer cases. Kalispell is the referral center for a large rural area. Patients come from Libby, Polson, Ronan, Eureka and the Hi-Line, often by ground or air ambulance. Some malpractice cases are about what happened in Kalispell. Others are about a delay in getting a patient there, or a delay in sending a patient on to Missoula, Seattle or Salt Lake City for care Kalispell doesn’t provide. Transfer records, call logs and the timing of each decision become central.

The kinds of cases we evaluate:

  • missed or delayed diagnoses, such as stroke, heart attack, sepsis, cancer or spinal cord compression;
  • surgical errors and post-operative complications that weren’t caught;
  • medication errors;
  • emergency department discharges that shouldn’t have happened;
  • nursing failures to monitor and escalate;
  • in skilled nursing, pressure injuries and falls.

A small medical community. In a valley this size, local physicians know one another, and many practice in the same system. Montana law also sets strict rules for who can testify on the standard of care (§ 26-2-601, MCA). We usually retain qualified experts from outside the region, so a reviewing physician has no local relationships to protect.

What happens after a medical malpractice injury in Kalispell?

  1. Get the complete records, including the electronic audit trail, not just the printed chart. When your care involved more than one Logan Health facility, request records from each. We handle requests, including imaging and monitoring data.
  2. Montana Medical Legal Panel. Claims against physicians, dentists, podiatrists and licensed health care facilities must go to the panel before suit (§§ 27-6-301, 27-6-701, MCA). Filing with the panel pauses the deadline (§ 27-6-702, MCA). The panel’s decision doesn’t bind you, but it is an important early test of the case.
  3. Lawsuit. After the panel, a case against a Flathead County provider is filed in the Eleventh Judicial District Court at the Flathead County Justice Center, 920 South Main Street, Kalispell. The five departments of that court hear the district’s civil cases, and a Flathead County jury decides the facts.
  4. Federal claims. Care at a VA facility or a federally supported health center is handled differently. The claim is presented to the federal agency within 2 years (28 U.S.C. § 2401(b)). Any suit is filed in federal court, the Missoula Division for Flathead County.

Montana law that applies

In short; our Montana medical malpractice lawyer page covers each rule in depth.

  • Deadline: generally 2 years from the injury or its discovery, and never more than 5 years (§ 27-2-205, MCA).
  • Damages cap: noneconomic damages are limited to $350,000 for claims first filed with the panel in 2026, rising to $400,000 on January 1, 2027. Medical bills and lost earnings are not capped (§ 25-9-411, MCA).
  • Expert testimony: required, and limited to qualified witnesses (§ 26-2-601, MCA).
  • Shared fault rules still apply (§ 27-1-702, MCA).

Why hire a Great Falls firm for a Kalispell case?

Being outside the valley is an advantage in a malpractice case. We are based in Great Falls, handle malpractice claims statewide, and have no ties to the Flathead medical community. Our attorneys travel to Kalispell and Missoula for panel hearings, depositions and trial. The work that decides these cases (record review, expert selection, trial preparation) doesn’t depend on where our office is.

Frequently Asked Questions

Can I sue Logan Health for a mistake at the Kalispell hospital? If the care fell below the standard and caused harm, yes. First the claim generally must go to the Montana Medical Legal Panel. Then it can be filed in Flathead County District Court.

My family member was transferred to Kalispell too late from a smaller hospital. Who is responsible? Possibly the sending hospital, the receiving hospital, or both. Transfer timing, call records and the decisions made at each step decide it. Claims against each provider must meet the same panel and deadline rules.

Will a Flathead County jury be fair to a local hospital? Jurors are instructed to decide on the evidence, and we select juries carefully. Strong, independent expert testimony matters most.

How long do I have to file a malpractice claim in Kalispell? Generally 2 years from the injury or its discovery, and no more than 5 years, with special rules for young children. Filing with the panel pauses the clock.

What if my care was at a VA or federally funded clinic in the valley? A federal claim must be presented to the agency within 2 years, and any lawsuit is filed in federal court in Missoula.
