Helena Medical Malpractice Lawyers: Hospital Negligence, Misdiagnosis and Surgical Errors in Lewis and Clark County

Boland Aarab PLLP.

Most Helena medical malpractice claims must go through the Montana Medical Legal Panel, which has its office in Helena, before a lawsuit can be filed. Claims against the Fort Harrison VA follow a different, federal process. Montana’s deadline is generally 2 years. The panel pauses it, but the federal claim deadline is separate, so act promptly.

Key Takeaways

  • Most claims must be filed within 2 years of the injury or its discovery, and never more than 5 years after the injury (§ 27-2-205, MCA).
  • Claims against physicians, dentists, podiatrists and licensed facilities go to the Montana Medical Legal Panel first (§§ 27-6-301, 27-6-701, MCA), and filing pauses the deadline (§ 27-6-702, MCA).
  • Claims against a VA facility follow the Federal Tort Claims Act and must be presented to the agency within 2 years (28 U.S.C. § 2401(b)).

Which Helena providers and facilities are involved?

Helena is a regional medical center for west-central Montana, and a malpractice case here usually involves one of a few kinds of providers.

St. Peter’s Health. Helena’s hospital at 2475 Broadway is the area’s main inpatient, surgical and emergency facility. Montana DPHHS designates it a State Area Trauma Hospital. The hospital has said it serves a five-county area and runs TeleStroke and TeleICU programs with University of Utah Health. For malpractice cases, that matters in two ways: care decisions may involve both Helena clinicians and remote specialists, and a patient may be transferred to a Level 2 regional trauma center in Great Falls or Missoula. Every provider in that chain, and every handoff, has to be examined.

Fort Harrison VA Medical Center. The VA medical center on Veterans Drive at Fort Harrison adjoins Helena. It is a 50-bed general medical and surgical facility. Care there is provided by the federal government, and that changes everything about the claim. The Montana Medical Legal Panel does not apply. Instead, a written administrative claim must be presented to the VA within 2 years under the Federal Tort Claims Act. Only after the VA denies it, or fails to act, can a lawsuit be filed in federal court. There is no jury in an FTCA case; a federal judge decides it.

Clinics, surgery centers and specialists across Helena, plus nursing and long-term care facilities. Those are covered on our Helena nursing home abuse page.

What happens after medical malpractice in Helena?

1. Get the records. You are entitled to your medical records. We collect the complete chart, including the electronic audit trail, imaging and any telemedicine consult notes.

2. Expert review. A malpractice case must be proven with qualified medical testimony, and Montana sets strict rules for who can give it (§ 26-2-601, MCA). We have the care reviewed before anything is filed.

3. The Medical Legal Panel. For most private providers, the next step is a written application to the Montana Medical Legal Panel. Its office is at 2021 Eleventh Avenue in Helena. The panel’s review is confidential, its decision is not binding, and the decision cannot be used as evidence later (§§ 27-6-606, 27-6-704, MCA). It is still the providers’ first look at your case, so we prepare for it as we would for trial.

4. The lawsuit. After the panel, a case against a Helena provider is generally filed in the First Judicial District Court at the Lewis and Clark County Courthouse, 228 Broadway (§ 3-5-101(1), MCA). An FTCA claim against the VA goes to the U.S. District Court’s Helena Division at the Paul G. Hatfield Federal Courthouse, 901 Front Street, which covers Lewis and Clark County (D. Mont. L.R. 1.2).

Two tracks, two deadlines. When a veteran was treated at both St. Peter’s and Fort Harrison, or by a VA provider and a community provider, both processes may be needed at once. The panel filing pauses the Montana deadline, but not the federal one.

Montana law that applies

Briefly: 2 years from injury or discovery, with a 5-year outer limit and special rules for young children (§ 27-2-205, MCA). The panel is required for most claims. Noneconomic damages are capped at $350,000 for claims first filed with the panel in 2026, rising to $400,000 on January 1, 2027 (§ 25-9-411, MCA). Medical bills and lost earnings are not capped. Our Montana medical malpractice lawyer page covers all of this in depth.

Why hire a Great Falls firm for a Helena case?

In a smaller medical community, patients sometimes worry about suing a local doctor or hospital, and about finding a lawyer without ties to it. We are based in Great Falls, handle malpractice cases across Montana, and come to Helena for the panel, depositions, hearings and trial. Our federal court experience also matters here, because FTCA cases against the VA are tried only in federal court.

Frequently Asked Questions

I was harmed at the Fort Harrison VA. Does the panel apply? No. VA claims follow the Federal Tort Claims Act. A written claim must be presented to the VA within 2 years, and any lawsuit is tried to a federal judge in the Helena Division.

Can I sue St. Peter’s Health for an ER mistake? If the care fell below the standard and caused harm, a claim may exist against the hospital and the providers involved. It generally goes to the Medical Legal Panel first, within the 2-year deadline.
