Butte Medical Malpractice Lawyers: Hospital Errors, Misdiagnosis and Delayed Transfers in Butte and Southwest Montana

Boland Aarab PLLP.

A medical malpractice claim from Butte must usually go to the Montana Medical Legal Panel before a lawsuit can be filed, and most claims must be filed within two years. A lawsuit is then typically heard in the Second Judicial District Court in Uptown Butte. Montana caps noneconomic damages in malpractice cases, but not medical bills or lost earnings.

How does health care work in Butte and the surrounding region?

Butte is the medical center for a large part of southwest Montana, and understanding how care flows through the region is often the key to a malpractice case.

  • St. James Healthcare in Butte, now part of Intermountain Health, is the region’s largest hospital. The Montana Department of Public Health and Human Services designates it an ACS Level III / State Area Trauma Hospital (DPHHS, Nov. 2025). A Level III facility provides assessment, resuscitation, surgery and intensive care, but may not have every specialist available within minutes.
  • Smaller hospitals send patients to Butte. DPHHS lists the Community Hospital of Anaconda and Barrett Hospital & Healthcare in Dillon as Community Trauma Hospitals, and Deer Lodge Medical Center and Ruby Valley Hospital in Sheridan as Trauma Receiving Facilities.
  • Higher-level centers receive patients from Butte. The nearest ACS Level II center is Providence St. Patrick Hospital in Missoula; the Level I centers are Billings Clinic and St. Vincent’s Healthcare in Billings.

That structure creates a particular kind of malpractice risk: delay. A patient seen in a smaller hospital, then Butte, then Missoula or Billings passes through several sets of hands. Many serious cases turn on whether someone recognized a condition in time, such as a stroke, sepsis, a bleed or a compartment syndrome, and whether the transfer happened fast enough, especially when winter weather over Homestake or the other passes delays ground or air transport.

Other common case types include surgical errors, medication errors, missed or delayed cancer diagnoses, emergency department misdiagnosis, and failures in post-operative monitoring.

What happens after medical malpractice in Butte?

Get your records. Request your complete chart, including nursing notes, imaging and the electronic audit trail, from every facility involved. We do this for our clients.

Do not wait. The deadline is short: generally 2 years from the injury or from when it was, or should have been, discovered, and never more than 5 years after the injury (§ 27-2-205, MCA).

The Medical Legal Panel. Before suing a physician, dentist, podiatrist or licensed health care facility, a claim must be submitted to the Montana Medical Legal Panel (§§ 27-6-301, 27-6-701, MCA). Filing with the panel pauses the deadline (§ 27-6-702, MCA). The panel’s decision does not bind you.

The lawsuit. After the panel, a case against a Butte provider is usually filed in the Second Judicial District Court, which serves Silver Bow County (§ 3-5-101(2), MCA), at the Silver Bow County Courthouse, 155 West Granite Street. Jurors come from Silver Bow County. Some cases, such as those involving federally funded clinics or Veterans Affairs care, must be brought in federal court; for Butte, that is the U.S. District Court, Butte Division, at the Mike Mansfield Federal Courthouse, 400 North Main Street (mtd.uscourts.gov). Where a patient was treated in several counties, we decide early where the case should be filed.

Montana law that applies

Here is the short version. Our Montana medical malpractice lawyer page covers the law in depth.

  • Deadlines: 2 years from injury or discovery, with a 5-year outer limit (§ 27-2-205, MCA).
  • Panel first for most claims against physicians and licensed facilities.
  • Damages cap: noneconomic damages are limited to $350,000 for claims first filed with the panel in 2026, rising to $400,000 on January 1, 2027 (§ 25-9-411, MCA). Medical bills and lost earnings are not capped.
  • Expert testimony is required, and Montana sets strict rules for who may give it (§ 26-2-601, MCA).

Why hire a Great Falls firm for a Butte case?

In a community the size of Butte, patients, jurors and health care workers often know one another, and a local practice may have ties to the hospital or its doctors. A firm based elsewhere can take a fresh look. We are based in Great Falls, handle cases statewide, and work with qualified medical experts from outside the region when needed. Our attorneys travel to Butte for depositions of providers, panel proceedings, hearings and trial.

We have no Butte office, and no Silver Bow County jury has heard one of our cases. Our jury trials have been in Cascade, Phillips, Meagher and Yellowstone Counties.
