Kalispell Mass Tort Lawyers: Class Actions, Multi-Plaintiff Cases and MDLs for Flathead Valley Residents
Boland Aarab PLLP.
When one product, one data breach or one act of contamination harms many people in the Flathead Valley, the law offers two main paths. In a mass tort, each injured person brings an individual claim, often alongside others. In a class action, representatives sue on behalf of a group. The choice affects how much control you keep over your own case, and in Montana it can be decided by statute.

What kinds of group harm reach Flathead Valley residents?
Large cases can feel distant, but they reach Kalispell in several ways.
- Nationwide product and drug cases. A defective medical device implanted at a Kalispell hospital, a recalled medication filled at a local pharmacy, or a vehicle part with a known defect can make a Flathead resident one of thousands of people with the same claim. These cases are often gathered into federal multidistrict litigation (MDL) in another state.
- Data breaches. A single cyberattack on a business, lender or employer can expose the records of many people at once, and the claims that follow are often handled as a group. See our Kalispell data breach page.
- Food and water contamination. An outbreak traced to a restaurant, an event caterer, an institutional kitchen or a small community water system can sicken many people at once. Each person’s illness and damages still have to be proven.
- Environmental releases. Industrial sites, spills and contaminated groundwater can affect a whole neighborhood. A government cleanup is a separate process from any individual injury or property claim. It neither proves nor rules out one, and each claim depends on its own evidence.
- Consumer and financial practices. Uniform fees, charges or misrepresentations may affect many account holders or borrowers at once.
What happens when a Flathead resident is part of a group case?
Figuring out the right path. We start with your facts: what happened, when, and what harm you have. Then we decide with you which of these fits:
- an individual case;
- a case with several plaintiffs joined together;
- a class action; or
- a claim filed into an existing MDL.
If you receive a class-action notice in the mail, read the deadlines. Opting out, objecting and filing a claim each have their own dates.
Where the case goes. Individual and multi-plaintiff cases against Montana defendants can be filed in the Eleventh Judicial District Court at the Flathead County Justice Center, 920 South Main Street, Kalispell. Cases against national companies usually end up in the U.S. District Court’s Missoula Division, which covers Flathead County. They may then be transferred to an MDL court elsewhere for pretrial proceedings and returned for trial. A class action affecting Montanans can also be filed in another Montana county.
Individual proof. Even when your case moves alongside thousands of others, your own medical records, losses and testimony decide what your claim is worth. We gather them from the start. For a Flathead client, that often means records from valley hospitals and clinics, pharmacy records, and product or purchase records.
You stay informed and in control. In a mass tort, no one can settle your individual claim without your agreement. If a class is certified, we can advise whether to stay in or opt out.
Montana law that applies
In brief; see our Montana mass tort and class action lawyer page for the full treatment.
- Joinder. Plaintiffs may join in one action when their claims arise from the same occurrence or series of occurrences and share a common question (Mont. R. Civ. P. 20). Related cases may be consolidated (Rule 42).
- Class actions. Certification requires numerosity, commonality, typicality and adequate representation (Mont. R. Civ. P. 23; Fed. R. Civ. P. 23). Class settlements need court approval as fair, reasonable and adequate.
- MDL. Federal cases with common questions of fact may be transferred to one court for coordinated pretrial proceedings (28 U.S.C. § 1407).
- No Consumer Protection Act class actions. Montana’s Consumer Protection Act allows an individual action but not a class action (§ 30-14-133, MCA). Some consumer claims must be brought one by one, or together as joined individual claims.
- Deadlines. Generally 3 years for injury claims (§ 27-2-204, MCA). Some claims are shorter, and product claims may face a repose period.
Why hire a Great Falls firm for a Kalispell case?
Group cases are federal-court cases more often than not, and they reward lawyers who keep an individual client’s facts in view. We are based in Great Falls, represent Montanans in multi-plaintiff and class litigation across the state, and travel to Kalispell and Missoula as a case requires. We do not have a Kalispell office.

Frequently Asked Questions
I got a class-action notice about a company I used in Kalispell. What should I do? Read the deadlines to file a claim, object or opt out. If you were seriously harmed, talk with a lawyer before the opt-out date about whether an individual claim makes more sense.
My medical device was implanted in Kalispell but the lawsuit is in another state. Can I still take part? Often yes. Your case can be filed and then transferred to the MDL court for pretrial proceedings, with your own lawyers staying on it.
Several neighbors got sick from the same source. Do we file one case? Possibly. Montana allows plaintiffs to join when claims arise from the same occurrence and share common questions. Each person’s damages are still proven individually.
Can I bring a class action under Montana’s Consumer Protection Act? No. The Act allows individual actions only. Other laws may allow class treatment.
Where would a Flathead group case be heard? In Flathead County District Court, in federal court in Missoula, or in an MDL court elsewhere for pretrial proceedings.
