Kalispell Data Breach Lawyers: Health Records, Identity Theft and Privacy Claims for Flathead Valley Residents

Boland Aarab PLLP.

If your personal or medical information was exposed in a data breach, Montana law requires the business to notify you “without unreasonable delay.” Montana’s newer consumer privacy law is enforced only by the Attorney General. Breach victims’ lawsuits usually rest on negligence, contract and consumer-protection law, and many become class actions in state or federal court.

Why data breaches matter in the Flathead Valley

A regional health system holds most local medical data. Logan Health is the largest health-care provider in northwest Montana, and patients from across a large region have records in its systems. In February 2022, Logan Health disclosed a cyberattack from November 2021. News reports put the number of patients and employees affected at about 213,000, including about 175,000 Montanans. The resulting class actions were consolidated. In March 2023 a Montana district judge approved a $4.3 million class settlement, according to the Daily Montanan. Boland Aarab was not involved in that case, and we describe it only because it is part of the public record and shows how these cases work:

  • the claims were brought by patients;
  • they were combined into one class action;
  • they resolved through a settlement fund, with a court deciding attorneys’ fees.

Notably, that case was heard in Cascade County District Court, not in Flathead County. Breach cases don’t always end up in the county where the victims live.

Other sources of breach risk in the valley include:

  • clinics and dental offices;
  • school districts;
  • local governments;
  • banks and credit unions;
  • employers’ payroll and HR vendors;
  • the large number of online businesses and vacation-rental platforms serving the tourist economy.

A breach at a national company affects Flathead residents too, and they are often part of a nationwide class.

What should you do after a data breach notice in Kalispell?

  1. Read the notice carefully. Note what information was exposed (Social Security number, medical information, account numbers or passwords), the dates, and any free monitoring offered.
  2. Protect yourself.
  3. Freeze your credit with all three bureaus.
  4. Change passwords.
  5. Watch your medical explanation-of-benefits statements for services you didn’t receive.
  6. Consider an IRS identity-protection PIN.
  7. Keep records of harm. Unauthorized charges, fraudulent accounts, time spent, out-of-pocket costs and any medical identity theft. In federal court, a concrete injury is required to sue for damages (TransUnion LLC v. Ramirez, 594 U.S. 413 (2021)), so documentation matters.
  8. Report identity theft to local law enforcement (the Kalispell Police Department or the Flathead County Sheriff’s Office) and to the FTC. A police report helps with creditors.
  9. Know where cases go.
  10. A breach case can be filed in state court, including the Eleventh Judicial District Court at the Flathead County Justice Center, 920 South Main Street, Kalispell, when the defendant or claims have the right connection to Flathead County.
  11. Large class actions are often filed in, or removed to, federal court under the Class Action Fairness Act (28 U.S.C. § 1332(d)). For Flathead County, that is the U.S. District Court’s Missoula Division.
  12. As the Logan Health case shows, some are filed elsewhere in Montana.

Montana law that applies

In short; our Montana data privacy and breach lawyer page has more.

  • Breach notice: a business that owns or licenses Montanans’ computerized personal information must notify affected residents without unreasonable delay (§ 30-14-1704, MCA).
  • Consumer Data Privacy Act: enforced only by the Attorney General. It creates no private right of action (§ 30-14-2817, MCA).
  • Consumer protection: the Montana Consumer Protection Act can support some claims (§ 30-14-133, MCA).
  • Health data: HIPAA requires breach notification by covered entities (45 C.F.R. § 164.404) but doesn’t itself give patients a right to sue. State-law claims fill that gap.
  • Deadlines: most negligence claims have a 3-year limit (§ 27-2-204(1), MCA). Other claims can have different limits.

Frequently Asked Questions

I got a breach notice from a Flathead Valley health provider. Should I do anything? Yes. Freeze your credit, watch your medical statements for services you didn’t receive, and keep the notice. If you have suffered losses, talk with a lawyer about your options.

Can I sue under Montana’s consumer data privacy law? No. That law is enforced only by the Montana Attorney General. Breach claims usually rely on negligence, contract or consumer-protection law instead.

Would a Kalispell data breach case be filed in Flathead County? Sometimes. It depends on the defendant and the claims. Large class actions often end up in federal court, and the Logan Health settlement was approved in Cascade County District Court.

Is there still time to join the Logan Health settlement? That settlement was approved in 2023, and claim deadlines under settlements like it are usually short. Check the settlement administrator’s notice, or ask us to look at your situation.

What kind of harm do I need to show? In federal court, a concrete injury, such as financial loss, fraud or other real harm, is required to sue for damages. The risk of future misuse alone is generally not enough.
